The article is devoted to the analysis of the legal status of family members and matrimonial relations according to the code "Tang lü shu yi" in medieval China during the reign of the Tang dynasty. The main provisions of medieval Chinese family law are considered, including the status of younger and older relatives, the norms for the conclusion and dissolution of marriage, as well as punishment for violating traditional marriage and family norms. The author gives the examples of traditions and customs in a medieval Chinese family. Separate and significant attention is paid to the criminal clarifications of the Tang dynasty, since it is in this source that family members are considered in detail as subjects of legal relations.
本文以《唐律疏议》为基础,对唐代中国中古时期家庭成员的法律地位和婚姻家庭关系进行分析;考察中国中世纪家庭法的主要规定,包括晚辈亲属的地位、结婚和解除婚姻的规范,以及对违反传统婚姻家庭规范的惩罚。作者列举中世纪中国家庭的传统习俗。本文特别注意唐代的刑事解释,因为这一文献将家庭成员作为法律关系主体进行研究。
